the risk of trial
From everything I’ve read, it seems like Dharun Ravi’s lawyer really dropped the ball on that case. His arguments, ranging from explaining Ravi was just a “stupid kid,” to denying he was homophobic, to saying he feared his computer might get stolen, seem like they would have painted a really disjointed theory of the case. Did the lack of clarity make the defense’s case seem uncredible and disingenuous to a jury?
It doesn’t seem like people expected the case to end in conviction. Ravi even turned down a plea deal of just community service! It makes me wonder about the predictability of jurys’ rulings. Maybe Ravi/Ravi’s defense team was just really overconfident and oblivious?
